the fase of a Lascar Crew signing on in Calcutta in a foreign
vessel. This is done before the Port Shipping Officer and not before the Consul of the vessel. The reason for this I am in-
-formed is that these men are often very troublesome (as shown
recently in the case of the crew of the "Syria" who were all sent to gaol) and the owners do this for their own protection. (2) The other exception is that of Chinese Crews being signed on
a foreign vessel in Singapore.
One of the foreign Consuls at this port, whose vessels are largely manned by Chinese, informs me the
reason for this is, that the Singapore Authorities do not wish
to lose their Chinese seamen and endeavour by signing the men on before the Port Authorities to ensure the foreign vessel
returning the men to Singapore to be paid off.
In Order to make quite sure what the custom
is in Bombay, I telegraphed to the F. & 0 Co. at that port on
the 3rd. instant and received a reply to the effect that "Bri-
-tish or foreign seamen sign articles of foreign vessels before Consul only"
The Harbour Master quotes from the Imperial
Merchant Shipping Act of 1894. I am not quite sure that I have
followed him correctly as I have not a copy of that act.
The act at present in force is 1894 cor-
-rected to 1897, This act, which applies to the Colonies also,
does not effect vessels flying a foreign flag except in special
instances where the safety of the ship is concerned and so
forth; as in the case of Section 462 where a foreign vessel can
be detained if overloaded. When any section does apply to a
foreign vessel this is specially stated in the section.
Section 734 provides for the application
of the Merchant Shipping Act to vessels of a foreign country
in such cases where the Government of that country expresses
itself desirous of the provisions of the Act being made applic-
-able to their vessels.
